Letter to OAG responding to Eanes ISD effort to withhold responsive information November 13, 2007 Open Records Division Office of the Attorney General Austin, Texas 78711 Re: Response to Eanes ISD request for an OAG opinion ruling – public information related to public bonds requested September 27, 2007 Please consider the following information regarding the public information (related to public bonds) requested from the Eanes ISD on September 27 , 2007: Documents reflecting information about public bonds are by law “super public information. Eanes ISD and Ellen Spalding are well aware that there is no pending litigation regarding the Americans with Disabilities Act. In fact, parents of disabled children and community members are working in good faith with the district towards compliance with this important federal law. The district has asserted to the public that our bond money will be spent on many issues including ADA. I have not taken legal action, threatened legal action, and/or hired an attorney. Further, regarding Ellen Spalding’s comments that I “have complained for years about the manner in which EISD chooses to spend its money,” I have the right and indeed the responsibility to stay informed and be involved. I also have the right to express my dissatisfactions about the operations of the school district as part of my right to free speech. Eanes ISD and Ellen Spalding’s repeated and deliberate effort to keep voters in the dark about the process by which their money is spent is inexcusable. Dianna Pharr |
