Bernadette,
As you know, last week, I decided to submit a
complaint with the Office of the Attorney
General regarding ongoing difficulties in
obtaining public information from Eanes ISD.
You once told me that the delay that I have
experienced in obtaining public information from
Eanes ISD is “goddamn pitiful”. I agree. I
believe that the district's response to my
requests is clearly an attempt to make the
process as difficult as possible. Sometimes,
the result is downright ridiculous. For
example, when the cost estimate is 40 cents, it
makes no sense for you, as school attorney, to
spend your time writing a three page cost
estimate letter and mailing it not once but
twice including a $5.63 charge for certified
mail. This is not cost effective for me or for
the district.
Further, I do not see a
good faith effort on your part to work
collaboratively so that this process can be as
cost effective as possible.
I am more than happy to pay the associated
fee ($1.73) for electronic copies (51 pages) for
TPIA 1747. You do not recall me agreeing to
pay that amount because I submitted a complaint
to the Office of the Attorney General instead.
Now that the OAG has contacted you and you have
apologized for the “confusion and inconvenience”
it is time to move forward so that I can pay and
obtain my documents.

Dear Ms. Pharr,
After further consideration of the facts and
circumstances attending your inspection visit on
July 8th, and after consultation with the Office
of the Attorney General, it has been determined
that your request to purchase documents that are
not available electronically is not, in this
particular circumstance, a redundant request. I
apologize for the confusion and inconvenience
that may have occurred.
The grant document and exhibits total 71 pages,
of which 30 pages are not available
electronically. The estimate of cost governing
the 30 pages is the estimate of cost sent to you
on June 17, 2008 (a copy is attached for your
convenience).
On July 24th, I sent you an estimate of cost to
provide the grant documents that are available
electronically. That estimate of cost totaled
$1.73. I do not recall receiving your agreement
to pay that cost.
Upon your written agreement to pay the cost
associated with providing the electronic version
of the documents, I will provide you the
electronic documents.
